Politics, not law, will decide whether Israel faces war crimes charges | | Jonathan Cook - Middle East Eye - In fact, Israel knows enough about which of its senior officials have broken international law - and how - that last summer it compiled a secret list of hundreds who were most likely to be investigated for war crimes.
But while Israel is only too aware of what its top war crimes suspects have been up to, Netanyahu is right to observe that last week’s ruling by the ICC is a political one. It is no coincidence that ICC judges found the backbone to assert jurisdiction over the occupied territories immediately after Donald Trump stepped down as US president. The timing of the ICC’s ruling may also be related to the fact that its chief prosecutor, Fatou Bensouda, is due to quit her post in a few months. She is unlikely to launch any investigations of Israelis before then, leaving the task to her successor.
Such a delay will buy Israel more time to campaign against it. Already, the Biden administration in the US, Germany and the Australian government have issued denunciations of the ICC decision.
Responding to Germany`s attack on the court, Hanan Ashrawi, a former senior Palestinian official, tweeted on Tuesday: “So your ‘legal view’ supersedes the ruling of the ICC judges and the resolutions of the UN [General Assembly]? From now on, IDF officers should think twice about obeying an order to participate in them, and risking serious consequences. Officers who nevertheless decide to continue participating in these acts of destruction had better make an effort to keep their identities secret, constantly wear masks regardless of the Covid-19 situation, and in general start acting like law-breakers evading law enforcement - because that is exactly what their legal status is about to become. The Decolonizing of Palestine Towards a One-State Solution | | Jeff Halper - AMEU - Settler colonialism is a form of colonialism. The settlers are not immigrants; they come with the intent of replacing the Native population, not integrating into their society. The settlers validate their right to the land by inventing narrative, stories, that justify their claims to the territory. The Zionist settlers claimed to be the “real” natives, both because they are “returning” to their native land and because, given its barrenness, only they love and “develop” it. -- Unlike Algeria, Kenya, Zimbabwe, Mozambique and Angola, where the settlers ultimately left, or the US, Canada, Australia, New Zealand and parts of Latin America where settler colonialism won out and the indigenous were reduced to marginal “Fourth World” status, Palestine/Israel, resembles more apartheid-era South Africa (and perhaps Tibet and Chechnya). In these cases the indigenous population was not rendered small and marginal, but remained major national groups who did not surrender their sovereignty to the settlers or their right of self-determination.
The Zionist settlers and the indigenous Palestinians have arrived at a draw. The former have proven strong enough to establish a state of their own but the Palestinians are strong enough to mount a major challenge to settler dominance. [bz] | 4/2/2021 |
